วันนี้ 10 พฤศจิกายน 2568 ศาลอุทธรณ์ได้มีคำพิพากษายืนตามศาลชั้นต้นให้ส่งตัวนายแส จี้นเจียง หรือ SHE Zhijiang บุคคลสัญชาติจีนและกัมพูชา ผู้ถูกร้องขอเป็นผู้ร้ายข้ามแดนไปดำเนินคดีที่สาธารณรัฐประชาชนจีนในความผิดฐานเปิดบ่อนกาสิโนโดยมิชอบด้วยกฎหมายอันเป็นความผิดตามประมวลกฎหมายอาญาของจีน โดยผู้ถูกร้องขอถูกกล่าวหาว่าเป็นผู้ออกคำสั่งให้สร้างและดำเนินกิจการเว็บไซต์การพนันออนไลน์ โดยมีเว็บไซต์การพนันออนไลน์ที่ใช้งานอยู่ 239 แห่ง และมีเงินทุนหมุนเวียนกว่า 2,775 พันล้านหยวน (หรือคำนวณเป็นเงินไทยประมาณ 12.63 ล้านล้านบาท) ทั้งยังมีส่วนในการสร้างเมืองใหม่แห่งเอเชียแปซิฟิกในเขตเศรษฐกิจพิเศษสุ่ยโกกู่ (ชเวโก๊กโก่) แห่งเอเชียแปซิฟิกของสาธารณรัฐแห่งสหภาพเมียนมา และถูกกล่าวหาว่าได้เปิดและเป็นหุ้นส่วนในบ่อนกาสิโน ๒ แห่งในพื้นที่เขตเศรษฐกิจพิเศษดังกล่าว ซึ่งผู้ถูกร้องขอกับพวกได้ชักชวนนักพนันชาวจีนให้เล่นการพนันที่สาธารณรัฐแห่งสหภาพเมียนมามาอย่างต่อเนื่องผ่านเว็บไซต์ต่าง ๆ จนทำกำไรได้เป็นเงินจำนวนมหาศาล

การส่งตัวนายแส จี้นเจียง หรือ SHE Zhijiang เป็นผู้ร้ายข้ามแดนให้แก่ทางการสาธารณรัฐประชาชนจีนในครั้งนี้เป็นการดำเนินการตามสนธิสัญญาระหว่างราชอาณาจักรไทยกับสาธารณรัฐประชาชนจีนว่าด้วยการส่งผู้ร้ายข้ามแดน ค.ศ. 1993 (พ.ศ. 2536) โดยเป็นคดีที่ทางการสาธารณรัฐประชาชนจีนให้ความสำคัญอย่างยิ่งยวดและติดตามสถานะการดำเนินการมาอย่างต่อเนื่องและใกล้ชิด

นายแส จี้นเจียง หรือ SHE Zhijiang ผู้ถูกร้องขอเป็นบุคคลที่ทางการสาธารณรัฐประชาชนจีนได้ส่งคำร้องขอให้จับกุมชั่วคราวมายังทางการราชอาณาจักรไทยเมื่อเดือนสิงหาคม 2565 โดยอัยการสูงสุดในฐานะผู้ประสานงานกลางตามพระราชบัญญัติส่งผู้ร้ายข้ามแดน พ.ศ. 2551 ได้อนุมัติให้ความช่วยเหลือตามที่ทางการสาธารณรัฐประชาชนจีนร้องขอ และมอบหมายให้พนักงานอัยการ สำนักงานต่างประเทศ เป็นผู้ดำเนินการประสานงานร่วมกับกรมสนธิสัญญาและกฎหมาย กระทรวงการต่างประเทศ และสำนักงานตำรวจแห่งชาติ จนกระทั่งเจ้าพนักงานตำรวจสามารถจับกุมตัวนายแส จี้นเจียง หรือ SHE Zhijiang ได้สำเร็จในเดือนเดียวกัน

หลังจากนั้น ทางการสาธารณรัฐประชาชนจีนได้มีคำร้องขอให้ส่งตัวนายแส จี้นเจียง หรือ SHE Zhijiang เป็นผู้ร้ายข้ามแดน และเมื่อเดือนพฤศจิกายน 2565 อัยการสูงสุดผู้ประสานงานกลางได้อนุมัติให้พนักงานอัยการ สำนักงานต่างประเทศ ยื่นคำร้องต่อศาลอาญาเพื่อขอให้ศาลมีคำสั่งให้ส่งตัวนายแส จี้นเจียง หรือ SHE Zhijiang ผู้ถูกร้องขอ เป็นผู้ร้ายข้ามแดนกลับไปดำเนินคดีที่สาธารณรัฐประชาชนจีน และในวันที่ 25 พฤษภาคม 2566 ศาลชั้นต้นก็ได้มีคำสั่งให้ขังผู้ถูกร้องขอไว้เพื่อส่งตัวข้ามแดนไปยังสาธารณรัฐประชาชนจีน ต่อมา เมื่อเดือนตุลาคม 2566 ผู้ถูกร้องขอได้ยื่นอุทธรณ์คำสั่งของศาลชั้นต้น และเมื่อเดือนธันวาคม 2566 พนักงานอัยการ สำนักงานต่างประเทศ ได้ยื่นคำแก้อุทธรณ์ภายในกำหนดระยะเวลาที่ศาลได้อนุญาตให้ขยาย และศาลได้มีคำสั่งรับไว้พิจารณา

ต่อมา นายแส จี้นเจียง หรือ SHE Zhijiang ผู้ถูกร้องขอ ได้ยื่นคำโต้แย้งในประเด็นข้อกฎหมายว่าพระราชบัญญัติส่งผู้ร้ายข้ามแดน พ.ศ. 2551 มาตรา 19 และมาตรา 21 ขัดหรือแย้งต่อรัฐธรรมนูญแห่งราชอาณาจักรไทย ศาลอุทธรณ์จึงได้ส่งคำโต้แย้งของผู้ถูกร้องขอให้ศาลรัฐธรรมนูญพิจารณาวินิจฉัยตามรัฐธรรมนูญแห่งราชอาณาจักรไทย มาตรา 212 หลังจากนั้น เมื่อวันที่ 22 ตุลาคม 2568 ศาลรัฐธรรมนูญได้มีมติเป็นเอกฉันท์วินิจฉัยว่าพระราชบัญญัติส่งผู้ร้ายข้ามแดน พ.ศ. 2551 มาตรา 19 และมาตรา 21 ไม่ขัดหรือแย้งต่อรัฐธรรมนูญแห่งราชอาณาจักรไทย และในวันนี้ 10 พฤศจิกายน 2568 ศาลอุทธรณ์ได้พิพากษายืนตามคำพิพากษาของศาลชั้นต้น โดยให้ส่งตัวผู้ถูกร้องขอเป็นผู้ร้ายข้ามแดนไปดำเนินคดีที่สาธารณรัฐประชาชนจีนภายใน 90 วันนับแต่วันที่ศาลมีคำพิพากษาถึงที่สุด ปัจจุบันคดีถึงที่สุดแล้ว

การดำเนินการเพื่อส่งตัวนายแส จี้นเจียง หรือ SHE Zhijiang ผู้ถูกร้องขอ เป็นผู้ร้ายข้ามแดนกลับไปดำเนินคดีที่สาธารณรัฐประชาชนจีนในครั้งนี้แสดงให้เห็นถึงความร่วมมืออย่างมีประสิทธิภาพในการปราบปรามอาชญากรรมข้ามชาติของเจ้าหน้าที่ผู้บังคับใช้กฎหมายทั้งพนักงานอัยการและเจ้าพนักงานตำรวจ การประสานงานที่มีประสิทธิภาพสูงยิ่งของกรมสนธิสัญญาและกฎหมาย กระทรวงการต่างประเทศ และสถานเอกอัครราชทูตสาธารณรัฐประชาชนจีนประจำประเทศไทย รวมถึงความรวดเร็วในการดำเนินงานของกรมราชทัณฑ์ ซึ่งล้วนเป็นกำลังสำคัญในความพยายามส่งตัวผู้กระทำความผิดที่อาศัยอยู่ในราชอาณาจักรไทยเพื่อกลับไปดำเนินคดีในสาธารณรัฐประชาชนจีน

 Office of the Attorney General Assists the People’s Republic of China in the Extradition of SHE Zhijiang, a Chinese and Cambodian National, to Face Prosecution for Operating Casinos

On 10 November 2025, the Court of Appeal rendered its judgment affirming the decision of the Court of First Instance to extradite Mr. SHE Zhijiang, a national of the People’s Republic of China and the Kingdom of Cambodia, to the People’s Republic of China to stand trial for operating illegal casinos, an offence under the Chinese Criminal Code. The requested person was accused of having ordered the establishment and operation of online gambling websites, with 239 websites reportedly active and a circulating capital of over 2.775 trillion Chinese Yuan (approximately 12.63 trillion Thai Baht). He was also allegedly involved in the construction of the Asia Pacific New City in the Shwe Kokko Special Economic Zone of the Republic of the Union of Myanmar, where he was accused of operating and partnering in two casinos within the said special economic zone. Together with his associates, he allegedly enticed Chinese nationals to participate in gambling activities in Myanmar through various online platforms, generating enormous profits.

The extradition of Mr. SHE Zhijiang to the Government of the People’s Republic of China was carried out pursuant to the Treaty between the Kingdom of Thailand and the People’s Republic of China on Extradition, 1993 (B.E. 2536). This case has been given utmost importance by the Chinese authorities, who have continuously and closely monitored its progress.

Mr. SHE Zhijiang, the requested person, is an individual for whom the Chinese authorities submitted a request for provisional arrest in August 2022. The Attorney General, in his capacity as the Central Authority under the Extradition Act B.E. 2551 (2008), approved assistance as requested by the Government of the People’s Republic of China and assigned public prosecutors from the International Affairs Department to coordinate with the Department of Treaties and Legal Affairs, Ministry of Foreign Affairs, and the Royal Thai Police. Subsequently, the police officers were able to successfully arrest Mr. SHE Zhijiang within the same month.

Thereafter, the Government of the People’s Republic of China submitted a formal request for the extradition of Mr. SHE Zhijiang. In November 2022, the Attorney General, acting as the Central Authority, approved for the public prosecutor of the International Affairs Department to file a petition with the Criminal Court requesting the Court to order the extradition of Mr. SHE Zhijiang to face trial in the People’s Republic of China. On 25 May 2023, the Court of First Instance ordered the detention of Mr. SHE Zhijiang for the purpose of extradition to the People’s Republic of China. Subsequently, in October 2023, Mr. SHE Zhijiang filed an appeal against the order of the Court of First Instance. In December 2023, the public prosecutor of the International Affairs Department submitted a reply to the appeal within the extended time period permitted by the Court, and the Court accepted it for consideration.

Subsequently, Mr. SHE Zhijiang filed a legal motion challenging the constitutionality of Sections 19 and 21 of the Extradition Act B.E. 2551 (2008), alleging that they were inconsistent with the Constitution of the Kingdom of Thailand. The Court of Appeal therefore referred the objection to the Constitutional Court for ruling under Section 212 of the Constitution. On 22 October 2025, the Constitutional Court rendered a unanimous decision that Sections 19 and 21 of the Extradition Act B.E. 2551 (2008) are not inconsistent with nor contrary to the Constitution.

Consequently, on 10 November 2025, the Court of Appeal rendered its final judgment upholding the lower court’s ruling, ordering that Mr. SHE Zhijiang be extradited to the People’s Republic of China within 90 days from the date the judgment became final. The case is now final.

The extradition of Mr. SHE Zhijiang to the People’s Republic of China demonstrates the effective cooperation among law enforcement authorities—including public prosecutors and police officers—and the efficient coordination by the Department of Treaties and Legal Affairs, Ministry of Foreign Affairs, and the Embassy of the People’s Republic of China in Thailand, as well as the swift execution by the Department of Corrections. All parties played a crucial role in ensuring that a fugitive residing in the Kingdom of Thailand is brought to face justice in the People’s Republic of China.
